Subscription Terms and Conditions for Fluoride Free Living Buck the System

By enrolling in the Fluoride Free Living Buck the System subscription service (“Subscription Service”), you (“Subscriber” or “you”) agree to be bound by the following Terms and Conditions (“Terms”). These Terms govern your participation in the Subscription Service offered by Fluoride Free Living Buck the System (“we,” “us,” or “our”), including enrollment, payment, delivery, cancellation, and related matters. Please read these Terms carefully before subscribing. If you do not agree to these Terms, you may not participate in the Subscription Service.

1. Subscription Overview

The Subscription Service provides recurring delivery of Fluoride Free Living Buck the System products or services (collectively, “Products”), such as fluoride-free wellness products, as specified at the time of your enrollment. By subscribing, you authorize Fluoride Free Living Buck the System to charge your designated payment method on a recurring basis (every 30 days) for the subscription fee, plus any applicable taxes and shipping costs, until you cancel your subscription in accordance with these Terms.

  • Subscription Plan: The specific Products, frequency, and pricing are detailed at checkout. For example, a subscription includes a monthly delivery of fluoride-free products for a fee of $49.99 plus $5.00 shipping, subject to applicable taxes.
  • Automatic Renewal Disclosure: By enrolling, you consent to automatic renewal of your subscription every 30 days until canceled. You will receive a reminder notice 5–7 days before each billing cycle via email or your account portal.
  • Automatic Termination: Unless you expressly opt to renew, your subscription will automatically terminate after 12 months, and no further charges will be processed unless you re-enroll.
  • Binding Agreement: These Terms, together with our Privacy Policy (https://fluoridefreeliving.com/privacy-policy) and Returns Policy (https://fluoridefreeliving.com/returns-policy), constitute a legally binding agreement between you and Fluoride Free Living Buck the System. Your enrollment, including checking the acceptance box at checkout, confirms your agreement to these Terms.

2. Eligibility and Enrollment

To enroll in the Subscription Service, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction.
  • Provide accurate, complete, and current information, including your full legal name, billing address, shipping address, and valid payment method.
  • Maintain and promptly update your account information to ensure its accuracy.

By enrolling, you represent and warrant that:

  • You have the legal capacity to enter into this agreement.
  • All information provided is true, accurate, and complete.
  • You authorize Fluoride Free Living Buck the System to charge your payment method for the subscription fees and any applicable taxes or shipping costs on a recurring basis.

3. Subscription Charges and Billing

  • Billing Cycle: You will be charged the subscription fee of $49.99, plus $5.00 shipping and any applicable taxes, every 30 days starting from the date of your initial subscription purchase. Charges will be processed automatically at the beginning of each billing cycle unless you cancel your subscription in accordance with Section 6.
  • Subscription Fee Changes: Fluoride Free Living Buck the System reserves the right to adjust the subscription fee or add new fees (e.g., for additional services or shipping cost changes). We will notify you at least 30 days before any fee change via email or your account portal. If you do not agree to a fee change, you may cancel your subscription before the next billing cycle.
  • Payment Authorization: By enrolling, you authorize Fluoride Free Living Buck the System to charge your designated payment method (e.g., credit card, debit card, or other accepted method) for all amounts due under these Terms. If a payment fails (e.g., due to an invalid or expired payment method), we may suspend or terminate your subscription until payment is successfully processed. You agree to maintain a valid payment method on file.
  • Taxes: You are responsible for any applicable sales, use, or other taxes associated with your subscription, which will be added to your charges as required by law.
  • Billing Notifications: We will provide electronic notification of upcoming charges 5–7 days before each billing cycle via email to the address provided or through your account portal on https://fluoridefreeliving.com/. You consent to receive electronic communications related to your subscription.

4. Shipping and Delivery

  • Shipping Frequency: Products will be shipped every 30 days as specified in your subscription plan.
  • Delivery Times: Estimated delivery times vary based on your location, selected shipping method, and external factors (e.g., carrier delays, weather, or force majeure events). Fluoride Free Living Buck the System is not responsible for delays outside our reasonable control, but we will work with you to resolve issues where possible.
  • Address Updates: You must notify us of any changes to your shipping address at least 7 days before the next scheduled shipment via your account on https://fluoridefreeliving.com/ or by emailing info@fluoridefreeliving.com. Fluoride Free Living Buck the System is not liable for misdelivered or undelivered Products due to inaccurate or outdated address information.
  • Risk of Loss: Title and risk of loss for Products pass to you upon delivery to the shipping carrier. We are not responsible for lost, stolen, or damaged shipments once they are in the carrier’s possession, though we may assist with filing claims with the carrier where applicable.

5. Subscription Management

  • Account Access: You may manage your subscription, including updating payment methods, modifying shipping addresses, or viewing upcoming shipments, through your account on https://fluoridefreeliving.com/ or by contacting our customer service team at info@fluoridefreeliving.com.
  • Modifications: You may request changes to your subscription (e.g., pausing shipments or adjusting frequency) subject to our approval and any applicable restrictions. Contact customer service at info@fluoridefreeliving.com for assistance.
  • Suspension: Fluoride Free Living Buck the System reserves the right to suspend or terminate your subscription if you fail to comply with these Terms, including failure to provide a valid payment method, engaging in fraudulent activity, or violating applicable law.

6. Cancellation

  • Cancellation by Subscriber: You may cancel your subscription at any time by:
    • Logging into your account on https://fluoridefreeliving.com/ and following the cancellation instructions in the subscription management portal, or
    • Emailing our customer service team at info@fluoridefreeliving.com.
    • Cancellations must be received at least 1 business day before the next billing cycle to avoid charges for the upcoming shipment. Cancellation requests received after this deadline may result in processing of the next scheduled shipment and charge. You will receive a confirmation email upon successful cancellation.
  • Cancellation by Us: Fluoride Free Living Buck the System may cancel your subscription at our discretion, including but not limited to non-payment, violation of these Terms, or unavailability of Products. We will notify you via email and refund any prepaid amounts for undelivered Products, unless the cancellation is due to your breach of these Terms.
  • Effect of Cancellation: Upon cancellation, you will receive no further shipments or charges, except for any outstanding payments owed for Products already delivered.

7. Refunds and Returns

  • No Refunds for Subscription Fees: Subscription fees are non-refundable once processed, except as required by applicable law or as specified below.
  • Defective or Incorrect Products: If you receive a damaged, defective, or incorrect Product, you must notify Fluoride Free Living Buck the System within 7 days of receipt by emailing info@fluoridefreeliving.com. We will, at our discretion, provide a replacement, refund, or credit for the affected Product. You may be required to return the defective Product at our expense using a prepaid shipping label we provide. Please do not return Products without prior authorization.
  • Returns Policy: You may return unopened, unused Products within 14 days of receipt for a refund or credit, subject to our Returns Policy (https://fluoridefreeliving.com/returns-policy). To initiate a return, email info@fluoridefreeliving.com with your order number and reason for return. You are responsible for return shipping costs unless the return is due to our error (e.g., defective or incorrect Product).

8. Changes to Subscription Terms

Fluoride Free Living Buck the System reserves the right to modify these Terms or the Subscription Service at any time. Any changes will be communicated to you via email or through your account portal at least 30 days before they take effect, unless a shorter notice period is required by law. If you do not agree to the updated Terms, you may cancel your subscription before the changes take effect. Continued participation in the Subscription Service after the effective date of any changes constitutes your acceptance of the updated Terms.

9. International Subscribers

If you reside outside the United States, additional terms may apply to comply with local laws:

  • European Union (GDPR): We comply with the General Data Protection Regulation by ensuring your personal data is processed lawfully and transparently. See our Privacy Policy (https://fluoridefreeliving.com/privacy-policy) for details.
  • Right of Withdrawal: EU subscribers may cancel their subscription and return Products within 14 days of receipt for a full refund, in accordance with EU consumer protection laws. Contact info@fluoridefreeliving.com to exercise this right.
  • Taxes and Duties: International subscribers are responsible for any customs duties, import taxes, or fees imposed by their country.

10. Limitation of Liability

To the fullest extent permitted by law, Fluoride Free Living Buck the System, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with the Subscription Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms or the Subscription Service shall not exceed the amount paid by you for the Subscription Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fluoride Free Living Buck the System, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your breach of these Terms, your use of the Subscription Service, or your violation of any applicable law or third-party rights.

12. Force Majeure

Fluoride Free Living Buck the System shall not be liable for any delay or failure to perform its obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, labor disputes, supply chain disruptions, or governmental actions.

13. Governing Law and Dispute Resolution

  • Governing Law: These Terms and the Subscription Service shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles.
  • Dispute Resolution: Any dispute arising out of or relating to these Terms or the Subscription Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Miami, Florida, and the language of arbitration shall be English. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be replaced with a provision that reflects the original intent as closely as possible.

15. Entire Agreement

These Terms, together with the Privacy Policy (https://fluoridefreeliving.com/privacy-policy) and Returns Policy (https://fluoridefreeliving.com/returns-policy), constitute the entire agreement between you and Fluoride Free Living Buck the System regarding the Subscription Service and supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral.
